Terms of Service

Effective Date: 29 March 2026

These Terms of Service ("Terms") govern your use of products and services provided by Elentus, including the ReadingFox mobile application. Elentus is operated by an individual developer based in Australia. By creating an account or using any Elentus service, you agree to be bound by these Terms.

1. Definitions

• "We," "us," "our" refers to Elentus.
• "You," "your" refers to the parent or guardian who creates and manages an account.
• "Child" refers to a minor whose profile is created and managed by you within the app.
• "Services" refers to all Elentus products, including the ReadingFox mobile application.
• "Content" refers to stories, vocabulary words, questions, game content, and any other educational material provided through the Services.

2. Eligibility

2.1 Age Requirement

You must be at least 18 years of age to create an account. By creating an account, you represent and warrant that you are at least 18 years old.

2.2 Parental or Guardian Status

The Services are designed for children in Australian school Years 3 to 7 (approximately ages 8 to 12). By adding a child profile, you represent that you are the parent or legal guardian of that child, or that you have proper authorisation from the child's parent or legal guardian.

3. Accounts

3.1 Account Creation

You may create an account using an email address and password, or through Apple Sign In on iOS devices. You are responsible for providing accurate information.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@elentus.com if you believe your account has been compromised.

4. Children's Accounts

4.1 Parental Management

Child profiles are created and managed entirely by you. Children do not have independent accounts, passwords, or login credentials.

4.2 Parental Responsibility

You are responsible for supervising your child's use of the Services and for all activity under child profiles associated with your account.

4.3 Children's Data

The collection and use of children's data is governed by our Privacy Policy.

5. Use of the Services

5.1 Permitted Use

The Services are provided for personal, non-commercial, educational use only.

5.2 Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose.
• Attempt to gain unauthorised access to the Services, other accounts, or our systems.
• Interfere with or disrupt the Services or the servers and networks that host them.
• Reverse-engineer, decompile, or disassemble any part of the Services.
• Scrape, crawl, spider, or use any automated means to access, extract, or collect Content from the Services.
• Copy, reproduce, download, archive, or create derivative works from any Content, except for incidental caching performed automatically by your device during normal use.
• Resell, sublicense, redistribute, publish, or otherwise make available any Content to any third party, in whole or in part, in any medium.
• Misrepresent your identity or your relationship to a child.
• Use the Services in any way that could harm or exploit children.

6. Content and Intellectual Property

6.1 Our Content

Elentus claims rights in the selection, arrangement, curation, and presentation of Content provided through the Services. Individual elements of Content may be generated by artificial intelligence and the copyright status of AI-generated works varies by jurisdiction. To the extent any Content is protectable, it is protected by copyright and other intellectual property laws.

6.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Content solely within the Services for personal, non-commercial, educational purposes. This licence does not include any right to copy, download, store, reproduce, redistribute, or create derivative works from the Content.

6.3 AI-Generated Content

Some Content, including stories and vocabulary exercises, may be generated or assisted by artificial intelligence. All such Content is reviewed and curated for educational appropriateness. While we take reasonable steps to ensure the originality of AI-generated Content, such Content may inadvertently contain similarities to existing copyrighted works. We do not intentionally reproduce third-party copyrighted material and will promptly address any identified instances of infringement.

6.4 Copyright Infringement Notices

If you are a copyright holder and believe that Content available through the Services infringes your copyright, please contact us at support@elentus.com with the following information:

• A description of the copyrighted work you believe has been infringed.
• A description of the Content within the Services that you believe is infringing, with sufficient detail for us to identify it.
• Your contact information (name, address, email, telephone number).
• A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

Upon receiving a valid notice, we will investigate promptly and, where appropriate, remove or disable access to the allegedly infringing Content.

6.5 No Guarantee of Originality

Given the nature of AI-generated content, Elentus does not warrant or guarantee that any Content is free from similarity to existing works. Elentus is not liable for any unintentional resemblance between AI-generated Content and third-party copyrighted material, provided that Elentus acts promptly to remove or modify Content upon being made aware of a credible infringement claim.

7. Subscription and Payment

7.1 Current Model

The Services are currently offered free of charge. We reserve the right to introduce paid features or subscription plans in the future.

7.2 Future Changes

If we introduce paid features, we will notify you in advance. Any paid features will be clearly identified before purchase.

7.3 App Store Terms

Purchases made through the Apple App Store or Google Play are also subject to the terms of those platforms.

8. Disclaimers

8.1 "As Is" Provision

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory.

8.2 Educational Content

The Services are designed to support reading and vocabulary development but are not a substitute for formal education, professional tutoring, or specialist intervention. We do not guarantee specific educational outcomes.

8.3 Availability

We do not guarantee that the Services will be available at all times. We may modify, suspend, or discontinue any part of the Services at any time.

9. Limitation of Liability

9.1 Maximum Liability

To the maximum extent permitted by law, the total liability of Elentus shall not exceed the amount you have paid us in the twelve months preceding the claim, or fifty Australian dollars (AUD $50), whichever is greater.

9.2 Exclusion of Certain Damages

To the maximum extent permitted by law, Elentus shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

9.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded by agreement.

10. Termination

10.1 Termination by You

You may terminate your account at any time by deleting it through the app or by contacting support@elentus.com. All your data will be permanently deleted.

10.2 Termination by Us

We may suspend or terminate your account if we reasonably believe you have violated these Terms. Where possible, we will provide notice.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. If you are located outside Australia, you agree that Australian law applies to these Terms, without regard to conflict of law principles.

12.2 Dispute Resolution

Before initiating any formal legal proceedings, you agree to contact us at support@elentus.com and attempt to resolve the dispute informally for at least 30 days. If informal resolution is unsuccessful, any disputes shall be resolved through binding arbitration administered under the rules of the Australian Centre for International Commercial Arbitration (ACICA), unless prohibited by your local law.

12.3 Class Action Waiver

To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.

13. Indemnification

You agree to indemnify, defend, and hold harmless Elentus and its developer from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, your violation of any applicable law, or any activity under your account (including your children's use of the Services).

14. General Provisions

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Elentus. If any provision is found invalid, the remaining provisions continue in full force. Our failure to enforce any provision does not constitute a waiver. You may not assign your rights under these Terms without our consent. We may assign our rights and obligations without restriction.
